1. By using the CaboActivities.com website, you agree to be legally bound by these terms, which shall take effect immediately.
2. If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use CabosActivities.com.
3. Viator and/or Cabo Activities may change these Terms & Conditions at any time by posting changes online. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by Viator and/or Cabo Activities. Your continued use of CabosActivities.com after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
4. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use CaboActivities.com content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of CaboActivities.com content requires the prior written permission of Viator and/or Cabo Activities (if you're interested in becoming a Viator and/or Cabo Activities affiliate, please click here for more information).
5. You agree to use the CaboActivities.com website only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of CaboActivities.com .
6. Your use of CaboActivities.com or any Viator and/or Cabo Activities-affiliated sites is intended for personal, noncommercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make any speculative, false or fraudulent requests. You agree not to use robots or other automated means to access this site, unless specifically permitted by Viator and/or Cabo Activities.

Product Validity, Modifications & Amendments

7. All products, tours and services offered by Viator and/or Cabo Activities are valid as per the dates displayed at CaboActivities.com. Viator and/or Cabo Activities is not responsible or liable for any information that it does not directly provide.
8. All requests for modifications/amendments must be directed to the Viator and/or Cabo Activities Customer Care Team (click here to submit a "Date Amendment" request on an existing booking) who will process the request.
   1. 8.1 Viator and/or Cabo Activities does not charge a fee to amend or change the dates of an existing booking, as long as the request is received by our Customer Care team more than three (3) days ahead of your confirmed travel date.
   2. 8.2 It is not possible to change or modify a special event, theater or show ticket. Sales of these tickets are final and cannot be amended once your original purchase is confirmed.
   3. 8.3 All other date-change requests and amendments are subject to availability by our suppliers and/or service providers; Viator and/or Cabo Activities cannot guarantee the success of any date-change request.
   4. 8.4 If you request a date change within three (3) days or less of your confirmed travel date, Viator and/or Cabo Activities will attempt to honor your request; however changes made three days or less from your original travel date may attract an additional fee.
9. Occasionally our suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, etc. As a result, Viator and/or Cabo Activities reserves the right to cancel, change or substitute any service, tour, ticket or product that you have booked at CaboActivities.com or through Viator and/or Cabo Activities-affiliated websites, at any time, for any reason.
   1. 9.1 In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price.
   2. 9.2 Notwithstanding the above, when we are informed in advance by our agents, service providers and/or suppliers of a significant change to a booking and/or to a tour, product or event, we make every reasonable effort to notify the consumer, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible.
10. For products noted as a "Worry-free Shore Excursion", if you are not returned to the ship in time to board, we will arrange the necessary transport to the next port-of-call. This policy applies only to our contracted local suppliers and only when, through no fault or action of your own, you are not returned to the ship in time to board. The policy is void in instances where delay is caused by your own actions and/or you have deviated from the Viator and/or Cabo Activities activity or tour. You must supply Viator and/or Cabo Activities with correct arrival and departure ship information and ensure there is enough time (min. 2 hours) between the tour end time and the ship departure time. You must contact Viator and/or Cabo Activities directly to request next port-of-call transportation arrangements as customers cannot book their own travel. Viator and/or Cabo Activities will select and book travel to the next port of call (not to exceed US$1000 per person).

Pricing & Inclusions/Exclusions

11. Prices listed on the CaboActivities.com website are per person, unless otherwise specified.
12. Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by Viator and/or Cabo Activities.
13. Price quotations are subject to change without notice, until a booking has been confirmed.
14. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.
15. Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under "Inclusions" on the product pages of CaboActivities.com or Viator and/or Cabo Activities-affiliated websites.

Payments & Cancellations

16. Viator and/or Cabo Activities accepts the following credit cards: Mastercard, Visa, American Express.
    1. 16.1 There is no charge or service fee for processing credit-card payments.
    2. 16.2 Full payment by credit card is required to make a reservation. Payment will be listed as Viator and/or Cabo Activities on the credit card statement.
17. No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals or any other services utilized.
18. Canceling a booking with Viator and/or Cabo Activities can result in cancellation fees being applied by Viator and/or Cabo Activities, as outlined below. Additional fees may be levied by the individual supplier/operator (see your Viator and/or Cabo Activities Voucher for specific details). When canceling any booking you will be notified via email, facsimile or telephone of the total cancellation fees.
    1. 18.1 Event, Attraction, Theater, Show or Coupon Ticket
       These are non-refundable in all circumstances.
    2. 18.2 Gift Certificate
       These are non-refundable in all circumstances.
    3. 18.3 Tour or Package Commencing During a Special Event Period
       These are non-refundable in all circumstances. This includes, but is not limited to, Trade Fairs, Public or National Holidays, School Holidays, New Year's, Thanksgiving, Christmas, Easter, Ramadan.
    4. 18.4 Other Tour Products & Services
       If you cancel at least 7 calendar days in advance of the scheduled departure or commencement time, there is no cancellation fee.
       If you cancel between 3 and 6 calendar days in advance of the scheduled departure or commencement time, you will be charged a 50% cancellation fee.
       If you cancel within 2 calendar days of the scheduled departure or commencement time, you will be charged a 100% cancellation fee.

Viator and/or Cabo Activities Vouchers

19. You will receive a personalized Viator and/or Cabo Activities Voucher for each tour, event or service booked. In order to access and print your Viator and/or Cabo Activities Voucher(s), you will be provided access to a secure webpage hosted by Viator and/or Cabo Activities that contains a link to your Viator and/or Cabo Activities Voucher(s).
20. You must provide the original, authentic Viator and/or Cabo Activities Voucher to the appropriate service provider in order to redeem your tour, ticket, or package. Your reservation cannot be honored or redeemed without presenting a valid Viator and/or Cabo Activities Voucher.
    1. 20.1 For security purposes, when redeeming your Viator and/or Cabo Activities Voucher you must present a valid Photo ID and sign the Viator and/or Cabo Activities Voucher. This is for identification purposes and helps us to prevent fraud.
    2. 20.2 In some cases Viator and/or Cabo Activities also requires that you present the credit card used to purchase your tour or ticket at the time of redemption. This generally applies only to attraction and show tickets. This helps us to prevent credit-card misuse. You will be advised at checkout whether or not you must present the credit card used for booking. In some cases Viator and/or Cabo Activities will waive this requirement, generally to facilitate gift purchases. However this requirement can only be waived by contacting Viator and/or Cabo Activities's Customer Care team once your booking has been confirmed, and any changes or amendments will be made at Viator and/or Cabo Activities's sole discretion.
    3. 20.3 If you make a purchase using a Viator and/or Cabo Activities Gift Certificate, Viator and/or Cabo Activities requires that you present the Gift Certificate used to purchase your tour, ticket or package at the time of redemption.
    4. 20.4 Please note that your Viator and/or Cabo Activities Voucher(s) can be confiscated - and immediately canceled without refund - if your signature and/or name do not match those shown on your credit card or Gift Certificate.

Viator and/or Cabo Activities Gift Certificates

21. Viator and/or Cabo Activities Gift Certificates can only be redeemed on the CaboActivities.com website. Viator and/or Cabo Activities Gift Certificates are redeemable against any product offered on the CaboActivities.com site.
22. Viator and/or Cabo Activities Gift Certificates are valid for two (2) years from the date of initial purchase, or as required by local law. Expiry date does not apply in California, Connecticut, Maine, Massachusetts, New Hampshire, Washington or other jurisdictions where prohibited by law.
23. Viator and/or Cabo Activities Gift Certificates remain valid until the entire value has been utilized or the expiry date has passed, subject to relevant local laws. If the value of the items you book is greater than your Gift Certificate, you can pay the balance using an acceptable credit card. If the value is less than your Gift Certificate, we'll store the balance in our database for you to use on another occasion. Note that your Gift Certificate, including any unused balance, expires two years after the date of issue, or as required by local law.
24. Viator and/or Cabo Activities Gift Certificates are not redeemable for cash.
25. Viator and/or Cabo Activities reserves the right to cancel Gift Certificates obtained fraudulently.
26. Viator and/or Cabo Activities is not responsible for stolen or lost Gift Certificates.
27. All Gift Certificate sales are final. Gift Certificates are not refundable.

Passports, Visas & Insurance

28. It is the responsibility of all passengers, regardless of nationality and destination, to check with the consulate of the country they are visiting for current entry requirements.
29. As visa and health requirements are subject to change without notice, we recommend that you verify health and visa requirements with the appropriate consulate prior to departure.
30. We strongly recommend that you purchase a comprehensive Travel Insurance Policy prior to departure. If you cancel your trip or significantly alter travel dates, many policies will reimburse the cost of cancellation fees and related expenses.

Disclaimers & Limitations of Liability

31. Under no circumstances will Viator and/or Cabo Activities or its agents, affiliates, service providers, suppliers, and/or distributors be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of CaboActivities.com regardless of the form of action.
32. Viator and/or Cabo Activities and its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of individual customers, shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours.
33. Furthermore, Viator and/or Cabo Activities and its agents and suppliers accept no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control.
34. Viator and/or Cabo Activities's content - including the information, names, images, pictures, logos, prices, dates, and availability regarding or relating to Viator and/or Cabo Activities, CaboActivities.com and/or to a Viator and/or Cabo Activities-affiliated website, service provider, operator and/or distribution partner - is provided "AS IS" and on an "AS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
35. At Viator and/or Cabo Activities we check and recheck the details about all the products and services we offer for accuracy. However, Viator and/or Cabo Activities does not warrant that functionality, content or information contained on CaboActivities.com will be uninterrupted or error free, that defects will be corrected, or that CaboActivities.com or the servers that make it available are free of viruses or bugs.
36. Some types of communication with Viator and/or Cabo Activities after you have made your purchase are in English. We will offer translation if you request it after receiving an English communication, but it may take longer.
37. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
